Welcome to Kiwi Sheepskins. These Terms & Conditions ("Terms") apply when you visit our website, purchase products from us or otherwise use our online services.

Our website, kiwisheepskins.com, is owned and operated by Kiwi Sheepskin Limited, trading as Kiwi Sheepskins, a company registered in New Zealand.

These Terms apply to customers purchasing through the European version of our website.

By placing an order with us, you agree to these Terms together with the policies referred to below.

Nothing in these Terms is intended to exclude, restrict or modify any mandatory consumer rights available to you under applicable European Union or national consumer law.

1. About Kiwi Sheepskins

Kiwi Sheepskins is a New Zealand-owned online retailer specialising in genuine sheepskin products and other New Zealand products.

Products ordered through our European website are sold by Kiwi Sheepskin Limited and shipped from New Zealand directly to customers throughout Europe.

2. Using Our Website

You may use our website for personal, non-commercial shopping and informational purposes.

You agree not to:

  • Use our website for unlawful or fraudulent purposes
  • Attempt to gain unauthorised access to our website or systems
  • Interfere with the operation or security of the website
  • Introduce malicious software, viruses or harmful code
  • Use automated systems to extract substantial amounts of website content without our permission
  • Copy or commercially exploit our website content except where permitted by law or with our written permission

We may restrict access to our website where reasonably necessary to protect our customers, systems or business.

3. Product Information

We take reasonable care to ensure product descriptions, photographs, specifications, sizes, colours and prices displayed on our website are accurate.

However, minor differences can occur between the appearance of a product on a screen and the physical product you receive.

Measurements provided on our website are approximate unless expressly stated otherwise.

Nothing in this section affects your statutory rights where goods are faulty, do not conform to the contract, do not match their description or otherwise fail to meet applicable consumer-law requirements.

4. Natural Sheepskin Products

Many Kiwi Sheepskins products are made from genuine natural sheepskin.

Sheepskin is a natural material, so variations in colour, shade, wool length, wool density, texture, shape, markings and overall appearance are normal.

No two natural sheepskins are exactly alike.

Product photographs are intended to provide a representative indication of the product you will receive. Natural variations between individual sheepskins are part of the character of genuine sheepskin and are not, by themselves, manufacturing defects.

For products made from multiple sheepskins, including our larger sheepskin rugs, we take considerable care to select and match individual pelts for a consistent overall appearance. Some natural variation between individual pelts may still occur.

This does not affect your statutory rights where a product fails to conform to the contract.

5. Prices & Currency

Prices displayed to customers using our European store are generally shown in euros (EUR).

Our website automatically displays applicable regional pricing based on your delivery destination.

EU VAT, Customs duties and other local taxes or import charges are not paid or reimbursed by Kiwi Sheepskins unless we expressly state otherwise.

Because orders are shipped from New Zealand, additional taxes, Customs duties, clearance charges or other import costs may be payable when your order enters the destination country.

Your bank, credit card provider or payment service may also charge its own currency conversion, international transaction or other fees. These charges are outside our control.

6. Placing an Order

When you place an order through our website, you are making an offer to purchase the products included in your order.

After checkout, you will normally receive an automated order confirmation by email. This confirms that we have received your order but does not necessarily mean that we have accepted it.

We may decline or cancel an order before dispatch where there is a reasonable and lawful reason to do so, including where:

  • A product is unavailable
  • There has been an obvious pricing or product-information error
  • Payment cannot be authorised
  • We reasonably suspect fraudulent or unauthorised activity
  • We are unable to deliver the product to the requested destination
  • Fulfilling the order would breach applicable law or import restrictions

If we cancel an order after payment has been taken, we will refund the applicable amount to your original payment method.

7. Pricing & Website Errors

We make reasonable efforts to ensure our website prices and product information are accurate.

Occasionally, an obvious pricing, technical or product-information error may occur.

If we identify a material error affecting your order before dispatch, we will contact you and, where appropriate, give you the option of proceeding on the corrected basis or cancelling the affected item or order.

If an order is cancelled, any amount already paid for the cancelled product will be refunded.

Nothing in this section limits your mandatory consumer rights or permits misleading pricing or unfair commercial practices.

8. Payment

Payment must be made using one of the payment methods available at checkout.

We currently use payment services including Shopify Payments and PayPal.

Your payment information is processed by the relevant payment provider in accordance with its terms and privacy practices.

Kiwi Sheepskins does not store your complete credit or debit card number on our own systems.

Orders may be subject to payment verification and fraud-prevention checks.

9. Pre-Orders, Made-to-Order & Custom Products

Some Kiwi Sheepskins products may be offered as pre-order, made-to-order or custom products.

Estimated production or availability timeframes are displayed on the relevant product page where applicable. These timeframes are estimates and may occasionally vary.

Pre-orders are charged in full when the order is placed.

Our voluntary cancellation and return rules for these products are explained in our Europe Returns, Exchanges & Warranty Policy.

Custom & Personalised Products

EU statutory withdrawal rights do not apply in certain circumstances, including the supply of goods made to the consumer's specifications or clearly personalised.

Where a Kiwi Sheepskins product genuinely falls within this exception, we will make this clear where appropriate.

A product being described by us as "made to order" does not, by itself, override your statutory rights. The nature of the product and applicable law determine whether a withdrawal exception applies.

Nothing in this section affects your rights where goods are faulty or do not conform to the contract.

10. Shipping & Delivery

Orders are shipped from Auckland, New Zealand.

Please refer to our Europe Shipping & Delivery Policy for current:

  • Estimated delivery timeframes
  • Tracking information
  • VAT, Customs duty and import-charge information

Delivery timeframes displayed on our website are estimates unless a particular delivery period has expressly been agreed.

Under EU consumer rules, where no different delivery period has been agreed, goods should generally be delivered within 30 days.

11. EU VAT, Customs Duties & Import Charges

Orders are shipped internationally from New Zealand.

Customers are responsible for applicable:

  • VAT
  • Customs duties
  • Clearance or brokerage fees
  • Local taxes
  • Carrier handling charges
  • Other import-related charges

unless we expressly state that a particular charge is included in the purchase price.

Kiwi Sheepskins does not reimburse VAT, Customs duties or other import charges paid directly by the customer to Customs authorities, couriers or other third parties unless we have expressly agreed otherwise or applicable law requires us to do so.

Refusing a parcel because VAT, Customs duty or another import charge is payable does not automatically remove responsibility for applicable charges or return costs.

12. Your EU Right of Withdrawal

In addition to our voluntary Returns Policy, consumers in the European Union generally have a statutory right to withdraw from most online purchases without giving a reason.

For eligible goods, the withdrawal period is generally 14 days from the day you, or a third party nominated by you other than the carrier, physically receive the goods. Special rules apply where an order is delivered in multiple shipments.

To exercise your right of withdrawal, you must communicate your decision clearly to us before the withdrawal period expires.

You do not need to provide a reason for exercising a statutory right of withdrawal.

Certain statutory exceptions apply, including certain goods made to your specifications or clearly personalised and certain sealed goods unsuitable for return for health-protection or hygiene reasons once unsealed.

13. Returning Goods After Withdrawal

After notifying us that you are exercising your statutory right of withdrawal, you must return the goods within the period required by applicable law.

Unless we have agreed otherwise or applicable law requires us to bear the cost, you are responsible for the direct cost of returning unwanted goods to us in New Zealand, provided this has been properly disclosed to you.

You may inspect and handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning.

If goods have been handled beyond what is reasonably necessary, we may be entitled to make an appropriate deduction for any resulting diminished value, where permitted by law.

For a valid statutory withdrawal, we will refund payments that EU law requires us to refund, including the cost of our least expensive standard delivery option where applicable.

If you selected a more expensive delivery method, we are not required to refund the additional amount above the cost of our standard delivery option.

Refunds will be made using the original payment method unless otherwise agreed and within the applicable statutory timeframe.

14. Our Voluntary 30-Day Returns Policy

In addition to statutory withdrawal rights, Kiwi Sheepskins provides a 30-day voluntary Returns & Exchanges Policy for eligible products.

Products returned under our voluntary policy generally need to be:

  • New and unused
  • Unworn and unwashed
  • In resalable condition
  • Returned with relevant packaging and accessories
  • Free from stains, odours and animal hair

Different conditions may apply to sale items, hygiene-sensitive products and certain custom or personalised products.

Our voluntary Returns Policy is additional to your statutory rights and does not replace, reduce or restrict those rights.

15. EU Legal Guarantee & Our 12-Month Product Warranty

This distinction is particularly important for European customers.

EU Legal Guarantee

Consumers in the EU have a minimum two-year legal guarantee of conformity for consumer goods. Some EU countries provide additional protection or longer periods under national law.

If goods are faulty, do not conform to the contract or do not look or work as advertised, statutory remedies can include repair or replacement at no cost, and in appropriate circumstances a price reduction or refund.

This legal guarantee exists independently of any commercial warranty offered by Kiwi Sheepskins.

Kiwi Sheepskins 12-Month Product Warranty

Kiwi Sheepskins separately provides a 12-month product warranty against manufacturing defects, subject to the conditions set out in our Europe Returns, Exchanges & Warranty Policy.

Our 12-month warranty is an additional commercial benefit and does not replace, shorten or restrict your EU legal guarantee.

Normal wear and tear, accidental damage, misuse, incorrect care and natural variations inherent in genuine sheepskin are not, by themselves, manufacturing defects under our commercial warranty.

Natural compression of sheepskin wool through normal use is also not, by itself, considered a manufacturing defect.

These exclusions from our voluntary warranty do not remove statutory rights where goods fail to meet applicable legal requirements.

16. Promotions, Sales & Discount Codes

From time to time, Kiwi Sheepskins may offer sales, promotional pricing, discount codes, competitions or other special offers.

Unless otherwise stated:

  • Promotions apply only during the advertised promotional period
  • Discount codes cannot be combined with other offers or discounts
  • Discounts cannot be applied retrospectively to completed orders
  • Promotional offers may be subject to product or market exclusions
  • Offers are subject to additional conditions clearly stated with the promotion

Where a promotion is limited by time, stock, country or another material condition, we will make that condition clear.

Nothing in a promotion or sale limits your statutory consumer rights.

17. Gift Cards & Store Credit

Where Kiwi Sheepskins issues a gift card or store credit, applicable conditions will be communicated when it is issued.

Store credit is not redeemable for cash except where required by applicable law.

Promotional store credits, competition prizes and goodwill credits may have different conditions from purchased gift cards.

Any expiry period or restriction is subject to applicable consumer law.

18. Product Care & Use

To help maintain your product, please follow any care instructions supplied with the product or provided on our website.

Some products require particular care because they are made from natural sheepskin, wool, leather or other natural materials.

Damage resulting from misuse, inappropriate cleaning, failure to follow reasonable care instructions or normal wear and tear may not be covered by our voluntary 12-month product warranty.

This does not affect statutory rights where goods fail to conform to the contract.

19. Website Content & Intellectual Property

Unless otherwise stated, content on the Kiwi Sheepskins website — including text, photographs, graphics, logos, product descriptions, designs and other material — is owned by or licensed to Kiwi Sheepskins and is protected by applicable intellectual property laws.

You may view and use our website for personal, non-commercial purposes.

You may not reproduce, distribute, modify, republish or commercially exploit substantial portions of our website content without our permission, except where permitted by law.

20. Reviews, Photos & Customer Content

If you submit a review, testimonial, photograph or other content to Kiwi Sheepskins, you confirm that you have the right to provide that content.

Where you separately give us permission to publish or use customer-submitted content, we may use it for the purposes and through the channels covered by that permission.

Our collection and handling of personal information associated with customer content is governed by our Europe Privacy Policy.

21. Third-Party Services & Links

Our website may contain links to third-party websites or use services provided by third parties, including payment, shipping, review and social-media providers.

We are not responsible for the content or privacy practices of independent third-party websites.

Where you use a third-party service, that service's own terms and privacy policies may also apply.

22. Availability of Our Website

We aim to keep our website available and operating correctly but cannot guarantee uninterrupted or error-free access.

We may temporarily suspend or restrict parts of the website for maintenance, security, technical or operational reasons.

Nothing in this section excludes or restricts liability where doing so would be unlawful.

23. Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any right, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the maximum extent permitted by applicable law, Kiwi Sheepskins will not be responsible for losses that are not reasonably foreseeable or that do not result directly from our breach of these Terms.

We do not seek to exclude liability where doing so would be unlawful.

Standard consumer contract terms in the EU must be drafted in plain, understandable language and must not create a significant imbalance between the consumer and trader. Unfair terms are not binding on the consumer.

24. Your European Consumer Rights

These Terms and our voluntary store policies are in addition to your mandatory consumer rights.

EU consumer protection includes rights concerning:

  • Clear pre-contract information
  • Online purchasing and withdrawal
  • Delivery
  • Faulty or non-conforming goods
  • Legal guarantees
  • Fair contract terms

EU legislation establishes a common framework, but additional national protections may apply in the country where you live.

Nothing in these Terms or another Kiwi Sheepskins policy is intended to remove a mandatory consumer right that cannot lawfully be excluded.

25. Privacy

Our collection, use and handling of personal information is governed by our Europe Privacy Policy.

This explains how we handle information relating to:

26. Events Outside Our Reasonable Control

We will not be responsible for a failure or delay in performing an obligation where that failure or delay results from circumstances genuinely outside our reasonable control.

This may include major transport disruption, natural disasters, severe weather, industrial disruption, government action or significant failures affecting third-party infrastructure.

Where an event affects an order, we will take reasonable steps to minimise disruption and communicate with affected customers where appropriate.

Nothing in this section limits mandatory consumer rights or remedies.

27. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products, policies or legal obligations.

The Terms applying to an order will generally be those in effect when the order is placed, except where a change is required by law.

The Last Updated date at the top of this page shows when these Terms were most recently revised.

28. Governing Law & Disputes

These Terms are governed by the laws of New Zealand.

However, where you are a consumer habitually resident in an EU Member State and we direct our commercial activities to that country, this choice of law does not deprive you of mandatory consumer protections that would otherwise apply under the law of your country of habitual residence. This reflects Article 6 of the EU's Rome I Regulation.

Nothing in these Terms requires you to give up a right to bring proceedings before a court or other forum available to you under applicable mandatory consumer law.

If a dispute arises, we encourage you to contact us first at support@kiwisheepskins.com so we can try to resolve the matter directly.

29. If Part of These Terms Is Unenforceable

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will not bind the consumer to the extent required by applicable law.

Where legally possible, the remainder of the Terms will continue to apply.
