These Terms apply to customers purchasing through the Canadian version of our website.
By placing an order with us, you agree to these Terms together with the policies referred to below.
Nothing in these Terms is intended to exclude, restrict or modify any rights you have under applicable Canadian consumer law that cannot legally be excluded, restricted or modified.
1. About Kiwi Sheepskins
Kiwi Sheepskins is a New Zealand-owned online retailer specialising in genuine sheepskin products and other New Zealand products.
Products ordered through our Canadian website are sold by Kiwi Sheepskin Limited and shipped from New Zealand directly to customers throughout Canada.

2. Using Our Website
You may use our website for personal, non-commercial shopping and informational purposes.
You agree not to:
- Use our website for unlawful or fraudulent purposes
- Attempt to gain unauthorised access to our website or systems
- Interfere with the operation or security of the website
- Introduce malicious software, viruses or harmful code
- Use automated systems to extract substantial amounts of website content without our permission
- Copy or commercially exploit our website content except where permitted by law or with our written permission
We may restrict access to our website where reasonably necessary to protect our customers, systems or business.
3. Product Information
We take reasonable care to ensure product descriptions, photographs, specifications, sizes, colours and prices displayed on our website are accurate.
However, minor differences can occur between the appearance of a product on a screen and the physical product you receive.
Measurements provided on our website are approximate unless expressly stated otherwise.
We may update product information, specifications, availability and pricing from time to time.
Nothing in this section limits any rights you may have where a product is defective, materially different from its description or otherwise fails to meet requirements imposed by applicable Canadian consumer law.
4. Natural Sheepskin Products
Many Kiwi Sheepskins products are made from genuine natural sheepskin.
Sheepskin is a natural material, so variations in colour, shade, wool length, wool density, texture, shape, markings and overall appearance are normal.
No two natural sheepskins are exactly alike.
Product photographs are intended to provide a representative indication of the product you will receive. Natural variations between individual sheepskins are part of the character of genuine sheepskin and are not, by themselves, manufacturing defects.
For products made from multiple sheepskins, including our larger sheepskin rugs, we take considerable care to select and match individual pelts for a consistent overall appearance. Some natural variation between individual pelts may still occur.
This does not affect any statutory rights you may have if a product is defective or materially different from its description.
5. Prices & Currency
Prices displayed to Canadian customers are shown in Canadian dollars (CAD).
Our website automatically displays regional pricing based on your delivery destination.
Shipping charges are displayed according to our Canadian shipping rates and the applicable order value.
Canadian GST/HST, provincial taxes, Customs duties, brokerage or handling fees and other government or import charges are not paid or reimbursed by Kiwi Sheepskins unless we expressly state otherwise.
These charges may be collected separately by Canadian authorities, the carrier or another party involved in importing your order.

Your bank, credit card provider or payment service may also charge its own international transaction, currency conversion or other fees. These charges are imposed by the relevant financial institution and are outside our control.
6. Placing an Order
When you place an order through our website, you are making an offer to purchase the products included in your order.
After checkout, you will normally receive an automated order confirmation by email. This confirms that we have received your order but does not necessarily mean that we have accepted it.
We reserve the right to decline or cancel an order before dispatch where reasonably necessary, including where:
- A product is unavailable
- There has been an obvious pricing or product information error
- Payment cannot be authorised
- We reasonably suspect fraudulent or unauthorised activity
- We are unable to deliver the product to the requested destination
- Fulfilling the order would breach applicable law or import restrictions
If we cancel an order after payment has been taken, we will refund the applicable amount to the original payment method.
7. Pricing & Website Errors
We make reasonable efforts to ensure our website prices and product information are accurate.
Occasionally, an obvious pricing, technical or product information error may occur.
If we identify a material error affecting your order before dispatch, we may contact you to explain the error and give you the option of proceeding on the corrected basis or cancelling the affected item or order.
If the order is cancelled, any amount already paid for the cancelled product will be refunded.
Nothing in this section permits us to engage in false or misleading pricing.
Canadian competition law prohibits materially false or misleading representations, and the Competition Bureau also treats an advertised price that cannot actually be obtained because of mandatory non-government fees as problematic "drip pricing."
8. Payment
Payment must be made using one of the payment methods available at checkout.
We currently use payment services including Shopify Payments and PayPal.
Your payment information is processed by the relevant payment provider in accordance with its terms and privacy practices.
Kiwi Sheepskins does not store your complete credit or debit card number on our own systems.
Orders may be subject to payment verification and fraud-prevention checks.
9. Pre-Orders, Made-to-Order & Custom Products
Some Kiwi Sheepskins products may be offered as pre-order, made-to-order or custom products.
Estimated production or availability timeframes are displayed on the relevant product page where applicable. These timeframes are estimates and may occasionally vary.
Pre-orders are charged in full when the order is placed.
Our cancellation and return rules for pre-orders, made-to-order and custom products are explained in our Canada Returns, Exchanges & Warranty Policy.
Certain products produced specifically for an order, including certain large sheepskin rugs and sheepskin bed underlays, may not qualify for our voluntary change-of-mind cancellation, exchange or refund policy once production has commenced.
Any restriction in our voluntary policy remains subject to rights or remedies available under applicable Canadian law.
10. Shipping & Delivery
Orders are shipped from Auckland, New Zealand.

Delivery timeframes shown on our website are estimates unless we expressly agree otherwise.
We will normally provide tracking information once your order has been dispatched where tracking is available.
11. Canadian Taxes, Duties & Import Charges
Orders are shipped internationally from New Zealand into Canada.
Customers are responsible for any applicable:
- GST/HST
- Provincial sales taxes
- Customs duties
- Brokerage fees
- Carrier handling or clearance charges
- Other Canadian import charges
unless we expressly state that a particular charge is included in your purchase price.
Kiwi Sheepskins does not reimburse taxes, duties or import charges paid directly by the customer unless we have expressly agreed otherwise or applicable law requires us to do so.
Refusing to accept a parcel because taxes, duties or other import charges are payable does not automatically cancel the order or remove responsibility for applicable charges and return costs.
Customers are responsible for ensuring products they order can lawfully be imported into Canada.
12. Returns, Exchanges & Refunds
Kiwi Sheepskins provides eligible Canadian customers with our 30-day voluntary Returns & Exchanges Policy.
For eligible voluntary returns, products generally need to be:
- Returned within the applicable return period
- New and unused
- Unworn and unwashed
- In resalable condition
- Returned with relevant packaging and accessories
- Free from stains, odours and animal hair
Certain products may be excluded from voluntary change-of-mind returns, including hygiene-sensitive products and certain custom or made-to-order products.
Please refer to our Canada Returns, Exchanges & Warranty Policy before returning a product.
Our voluntary return policy is separate from any statutory rights or remedies that may apply under Canadian federal, provincial or territorial law.
13. Return Shipping & Refunds
For voluntary change-of-mind returns, customers are generally responsible for the cost of returning products to New Zealand.
For exchanges, customers are generally responsible for the return shipping cost and the applicable replacement shipping cost unless we agree otherwise.
For an eligible voluntary refund, deductions may be made in accordance with our Canada Returns, Exchanges & Warranty Policy, including applicable direct shipping costs and permitted non-refundable costs.
Taxes, Customs duties, brokerage fees and other import charges paid directly by a customer to Canadian authorities, couriers or other third parties are not normally refundable by Kiwi Sheepskins.
Where goods are defective or Canadian law provides additional remedies, different rules may apply.
14. Faulty Products & Our Product Warranty
Kiwi Sheepskins provides a 12-month product warranty against manufacturing defects, subject to the conditions set out in our Canada Returns, Exchanges & Warranty Policy.
Our warranty is in addition to and does not replace any statutory rights or remedies that apply to your purchase.
Normal wear and tear, accidental damage, misuse, incorrect care and natural variation in genuine sheepskin are not, by themselves, manufacturing defects.
Natural compression of sheepskin wool through normal use is also not, by itself, considered a manufacturing defect.

15. Promotions, Sales & Discount Codes
From time to time, Kiwi Sheepskins may offer sales, promotional pricing, discount codes, competitions or other special offers.
Unless otherwise stated:
- Promotions apply only during the advertised promotional period
- Discount codes cannot be combined with other offers or discounts
- Discounts cannot be applied retrospectively to completed orders
- Promotional offers may be subject to product or market exclusions
- Offers are subject to any additional conditions clearly stated with the promotion
Where a promotion is limited by time, stock, country or another material condition, we will aim to make that condition clear.
Sale & Regular Prices
Where we advertise a saving against a regular price, that regular price is intended to represent a genuine price at which the product has been offered or sold.
Canadian rules in this area are particularly worth including in your internal marketing processes. The Competition Bureau says businesses cannot invent an inflated "regular price" to make a discount appear greater than it really is and uses both a volume test and a time test when assessing ordinary selling-price claims.
Nothing in a promotion or sale limits rights that cannot lawfully be excluded.
16. Gift Cards & Store Credit
Where Kiwi Sheepskins issues a gift card or store credit, any specific conditions will be communicated when it is issued.
Store credit is not redeemable for cash except where required by applicable law.
Promotional store credits, competition prizes and goodwill credits may have different conditions from purchased gift cards.
Any expiry period or other restriction will be subject to applicable Canadian law.
17. Product Care & Use
To help maintain your product, please follow any care instructions supplied with the product or provided on our website.
Some products require particular care because they are made from natural sheepskin, wool, leather or other natural materials.
Damage resulting from misuse, inappropriate cleaning, failure to follow reasonable care instructions or normal wear and tear may not be covered by our voluntary product warranty.
This does not affect statutory rights or remedies that may apply where a product is defective.
18. Website Content & Intellectual Property
Unless otherwise stated, content on the Kiwi Sheepskins website — including text, photographs, graphics, logos, product descriptions, designs and other material — is owned by or licensed to Kiwi Sheepskins and is protected by applicable intellectual property laws.
You may view and use our website for personal, non-commercial purposes.
You may not reproduce, distribute, modify, republish or commercially exploit substantial portions of our website content without our permission, except where permitted by law.
19. Reviews, Photos & Customer Content
If you submit a review, testimonial, photograph or other content to Kiwi Sheepskins, you confirm that you have the right to provide that content.
Where you separately give us permission to publish or use customer-submitted content, we may use it for the purposes and through the channels covered by that permission.
Reviews and testimonials used in our marketing should represent genuine customer experiences.
Our collection and handling of personal information associated with customer content is governed by our Canada Privacy Policy.
20. Third-Party Services & Links
Our website may contain links to third-party websites or use services provided by third parties, including payment, shipping, review and social-media providers.
We are not responsible for the content or privacy practices of independent third-party websites.
Where you use a third-party service, that service's own terms and privacy policies may also apply.
21. Availability of Our Website
We aim to keep our website available and operating correctly, but cannot guarantee uninterrupted or error-free access.
We may temporarily suspend or restrict parts of the website for maintenance, security, technical or operational reasons.
Nothing in this section excludes or restricts liability where it would be unlawful to do so.
22. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified under applicable law.
To the maximum extent permitted by applicable law, Kiwi Sheepskins will not be responsible for losses that are not reasonably foreseeable or that do not result directly from our breach of these Terms.
We do not seek to exclude liability where doing so would be unlawful.
If you purchase products primarily for business or commercial purposes, different legal rules may apply.
23. Your Canadian Consumer Rights
Consumer protection in Canada is governed by a combination of federal, provincial and territorial laws.
The rights and remedies available to you may therefore vary depending on the province or territory in which you live and the circumstances of your purchase.
Our Terms and voluntary policies do not replace, restrict or remove consumer rights that cannot lawfully be waived or excluded.
This is why I would not add the UK wording giving every Canadian customer a universal 14-day cancellation period. Canada's federal Office of Consumer Affairs instead advises consumers to review the seller's terms, shipping, return and exchange arrangements and notes that consumer laws and standards can differ in international purchases.
Where applicable Canadian law gives you rights or remedies beyond our voluntary policies, those statutory rights continue to apply.
24. Privacy
Our collection, use and handling of personal information is governed by our Canada Privacy Policy.
The Privacy Policy explains how we handle information relating to matters including:

- Payments
- Customer accounts
- Shipping
- Marketing
- Cookies
- Analytics and advertising
- Canadian privacy rights
Canada's federal private-sector privacy law, PIPEDA, establishes requirements for the handling of personal information in commercial activities, while provincial privacy laws may also apply depending on the circumstances.
25. Events Outside Our Reasonable Control
We will not be responsible for a failure or delay in performing an obligation where that failure or delay results from circumstances genuinely outside our reasonable control.
This may include major transport disruption, natural disasters, severe weather, industrial disruption, government action or significant failures affecting third-party infrastructure.
Where an event affects an order, we will take reasonable steps to minimise disruption and communicate with affected customers where appropriate.
Nothing in this section limits rights that cannot legally be excluded.
26. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, website, products, policies or legal obligations.
The Terms applying to an order will generally be those in effect when the order is placed, except where a change is required by law.

27. Governing Law & Disputes
These Terms are governed by the laws of New Zealand.
However, if you are a consumer in Canada, this choice of law does not deprive you of mandatory consumer protections available to you under applicable Canadian federal, provincial or territorial law that cannot lawfully be excluded by agreement.
Nothing in these Terms requires you to give up a right to bring a claim in a court, tribunal or other forum available to you under applicable mandatory consumer law.
If a dispute arises, we encourage you to contact us first at support@kiwisheepskins.com so we can try to resolve the matter directly.
28. If Part of These Terms Is Unenforceable
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally possible.
The remaining provisions will continue to apply.
